Terms of Service

BrushCue is operated by Dito Technologies LLC ("we," "us," or "our"). By creating an account or using BrushCue in any way, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use BrushCue.

BrushCue provides free, browser-based image editing tools powered by WebAssembly. The core tools run locally in your browser — no uploads required for basic use. Registered users can save and sync projects to BrushCue servers.

We provide BrushCue free of charge and reserve the right to modify, suspend, or discontinue any part of the service at any time without notice or liability.

You may use most BrushCue tools without an account. To save and sync projects, you must create an account with a valid email address.

• You are responsible for keeping your login credentials secure.
• You may not create more than one account per person.
• You must notify us immediately at privacy@brushcue.com if you suspect unauthorized access to your account.
• You must be at least 13 years old to create an account.

You retain full ownership of any images and projects you create with BrushCue. By saving a project to BrushCue servers, you grant Dito Technologies LLC a limited, non-exclusive, royalty-free license solely to store, process, and serve that content back to you. We do not use your content for any other purpose, including marketing or model training, without your explicit consent.

You are solely responsible for ensuring you have the rights to any images you upload or process through BrushCue.

You agree not to use BrushCue to:

• Process, store, or distribute any content that is illegal under applicable law, including but not limited to content that infringes third-party intellectual property rights.
• Create or distribute deceptive, fraudulent, or impersonating content — including manipulated images intended to mislead or harm others.
• Resell, sublicense, or otherwise provide access to BrushCue as a service to third parties without our written consent.
• Interfere with, overload, or attempt to gain unauthorized access to BrushCue or its underlying infrastructure.

We reserve the right to determine what constitutes a violation of these terms at our sole discretion.

BrushCue's tools, interface, branding, and all underlying technology are the property of Dito Technologies LLC and are protected by applicable intellectual property laws. These terms do not grant you any rights to our name, logo, trademarks, or source code.

BrushCue is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or free of viruses or other harmful components.

To the fullest extent permitted by law, Dito Technologies LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use BrushCue, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising from these terms or your use of BrushCue shall not exceed $100 USD.

We may suspend or terminate your account at any time if we determine, at our sole discretion, that you have violated these terms. You may delete your account at any time by contacting us at privacy@brushcue.com. Upon termination, your right to use BrushCue ceases and we will handle your data as described in our Privacy Policy.

These terms are governed by the laws of the United States, without regard to conflict-of-law principles. Any disputes arising from these terms shall be resolved in accordance with applicable US law.

We may update these terms from time to time. When we do, we will revise the effective date at the top of this page. Your continued use of BrushCue after changes are posted constitutes your acceptance of the updated terms. If the changes are material, we will make reasonable efforts to notify you.
